1. Agreement to Terms
By accessing or using the E-Park website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Account Registration
To access certain features of our service, you may be required to create an account. You can register using:
- Email and Password: You must provide a valid email address and create a secure password.
- Google Sign-In: You may authenticate using your Google account. By doing so, you authorize us to access your basic profile information as described in our Privacy Policy.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. User Responsibilities
When using our services, you agree to:
- Provide accurate and complete information, including valid vehicle license plate information.
- Arrive at the parking facility within the time window specified in your reservation.
- Comply with all rules and regulations of the parking facility.
- Not use another person's account without authorization.
- Not use our services for any unlawful purpose.
4. Booking and Payments
All bookings made through our platform are subject to availability. Prices are subject to change without notice. Payment is required at the time of booking. We use secure third-party payment processors (EPSG Secure) to handle all financial transactions. We do not store your complete credit card information on our servers.
5. Cancellations and Refunds
Cancellations may be made up to 1 hour before the scheduled entry time for a full refund. Cancellations made within 1 hour of the scheduled entry time may not be eligible for a refund. No-shows are not eligible for refunds. Please refer to your specific booking confirmation for detailed cancellation terms.
6. Third-Party Services
Our service integrates with third-party services including:
- Google: For authentication services. Your use of Google Sign-In is subject to Google's Terms of Service.
- Payment Processors: For secure payment handling.
- Mapping Services: For location and navigation features.
7. Intellectual Property
The E-Park name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of E-Park or its affiliates. You must not use such marks without our prior written permission.
8. Limitation of Liability
E-Park acts as an intermediary between you and parking facility operators. We are not responsible for:
- Damage to or theft of your vehicle while parked at any facility.
- Personal injury occurring at any parking facility.
- Actions or omissions of parking facility operators or their employees.
- Changes to parking facility availability, hours, or policies.
9. Disclaimer
The materials on E-Park's website are provided on an 'as is' basis. E-Park makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
10. Account Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the service will cease immediately. You may also delete your account at any time through your account settings.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of the service after any changes constitutes acceptance of the new terms.
12. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of New York, United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
